利用規約

This Terms of Use ("Terms") governs the use of applications and services ("Services") provided by StandFeet ("we", "us", or "the Developer"). By using our Services, you agree to these Terms.

本利用規約（以下「本規約」）は、StandFeet（以下「当方」）が提供するアプリケーションおよびサービス（以下「本サービス」）のご利用条件を定めるものです。本サービスをご利用いただいた時点で、本規約に同意したものとみなします。

1. Scope of Application / 適用範囲

These Terms apply to all applications published by StandFeet on the Apple App Store and any associated websites. These Terms apply in addition to any terms and conditions set by the platform (Apple Inc.).

本規約は、当方がApple App Storeにて公開するすべてのアプリケーション、および関連するWebサイトに適用されます。本規約は、プラットフォーム（Apple Inc.）が定める利用規約に加えて適用されます。

2. Service Description / サービスの内容

Our Services may include applications that use on-device AI technology (such as Stable Diffusion via Core ML) for content generation. All AI processing is performed locally on the user's device. We do not operate servers for content generation, and no user-generated content is transmitted to external servers through the AI generation process.

本サービスには、オンデバイスAI技術（Core MLを利用したStable Diffusionなど）によるコンテンツ生成機能を持つアプリケーションが含まれる場合があります。すべてのAI処理はユーザーの端末上でローカルに実行され、AI生成プロセスを通じてユーザー生成コンテンツが外部サーバーに送信されることはありません。

3. AI-Generated Content / AI生成コンテンツ

• Content generated by the AI features of our applications is created on the user's device. The responsibility for the use, sharing, and distribution of generated content rests with the user.

  当方のアプリケーションのAI機能により生成されたコンテンツは、ユーザーの端末上で生成されます。生成コンテンツの利用・共有・配布に関する責任はユーザーにあります。

• We do not guarantee the accuracy, appropriateness, or quality of AI-generated content. AI output may produce unexpected or unintended results.

  AI生成コンテンツの正確性、適切性、品質について、当方は一切保証しません。AI出力は予期しない結果を生じる可能性があります。

• The AI models used in our applications are based on third-party open-source models. Users should be aware that the legal status of AI-generated content may vary by jurisdiction.

  当方のアプリケーションで使用するAIモデルは、サードパーティのオープンソースモデルに基づいています。AI生成コンテンツの法的な取り扱いは、国・地域によって異なる場合がありますのでご留意ください。

4. Prohibited Use / 禁止事項

Users shall not engage in the following activities when using the Services:

本サービスの利用にあたり、以下の行為を禁止します。

• Reverse engineering, decompiling, or disassembling the application or its AI models

  アプリケーションまたはAIモデルのリバースエンジニアリング、逆コンパイル、逆アセンブル

• Extracting, copying, or redistributing the AI models or their weights

  AIモデルまたはその重みの抽出、複製、再配布

• Using the Services in any manner that violates applicable laws or regulations

  適用される法令に違反する方法での本サービスの利用

• Using generated content to infringe upon the rights of third parties

  生成コンテンツを用いた第三者の権利侵害

• Any activity that interferes with or disrupts the Services

  本サービスの運営を妨害する行為

5. Advertising / 広告について

Our applications may display advertisements provided by third-party advertising services (such as Google AdMob). Advertisement content is provided by these third-party services and is not controlled by us. Please refer to each application's Privacy Policy for details on data handling related to advertising.

当方のアプリケーションでは、第三者の広告配信サービス（Google AdMobなど）による広告が表示される場合があります。広告の内容は当該第三者サービスにより提供されるものであり、当方の管理下にはありません。広告に関するデータの取り扱いについては、各アプリケーションのプライバシーポリシーをご参照ください。

6. Intellectual Property / 知的財産

All intellectual property rights related to the Services, including but not limited to the application design, source code, UI elements, preset materials, and brand assets, belong to the Developer or their licensors. Users are not granted any rights to these except as expressly permitted in these Terms.

本サービスに関するすべての知的財産権（アプリケーションのデザイン、ソースコード、UI要素、プリセット素材、ブランド資産を含むがこれらに限定されない）は、当方またはそのライセンサーに帰属します。本規約で明示的に許可された場合を除き、ユーザーにこれらの権利は付与されません。

7. Disclaimer of Warranties / 免責事項

• The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

  本サービスは「現状有姿」で提供されるものであり、明示的または黙示的を問わず、いかなる種類の保証もいたしません。

• We do not warrant that the Services will be uninterrupted, error-free, or free of defects, or that they will meet your specific requirements.

  本サービスが中断なく、エラーなく、欠陥なく動作すること、またはユーザーの特定の要求を満たすことを保証しません。

• We shall not be liable for any damages arising from the use of or inability to use the Services, including but not limited to data loss, device malfunction, or any damages resulting from AI-generated content.

  本サービスの利用または利用不能に起因するいかなる損害（データの喪失、端末の不具合、AI生成コンテンツに起因する損害を含むがこれらに限定されない）について、当方は一切の責任を負いません。

• As a sole developer, we do not guarantee the continuity of the Services. Services may be modified, suspended, or terminated without prior notice.

  個人開発者として、本サービスの継続性を保証するものではありません。本サービスは、事前の通知なく変更、中断、または終了される場合があります。

8. Limitation of Liability / 責任の制限

To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability shall not exceed the amount paid by the user for the specific Service in question during the twelve (12) months preceding the claim, or JPY 1,000, whichever is greater.

適用法令が許容する最大限の範囲において、間接的、偶発的、特別的、結果的、または懲罰的損害、あるいは利益・収益の喪失について、当方は一切の責任を負いません。当方の賠償責任の総額は、請求に先立つ12ヶ月間にユーザーが当該サービスに対して支払った金額または1,000円のいずれか大きい方を上限とします。

9. Indemnification / 補償

You agree to indemnify, defend, and hold harmless the Developer from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) your use of the Services; (b) your use, sharing, or distribution of content generated through the Services; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

ユーザーは、以下に起因または関連して生じるすべての請求、損害、損失、責任、費用（合理的な弁護士費用を含む）について、当方を免責し、防御し、補償することに同意するものとします。(a) ユーザーによる本サービスの利用、(b) 本サービスを通じて生成されたコンテンツの利用・共有・配布、(c) 本規約への違反、(d) 第三者の権利の侵害。

10. Changes to Services / サービスの変更

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

当方は、事前の通知なく、本サービスの全部または一部を変更、中断、または終了する権利を有します。本サービスの変更、中断、または終了について、ユーザーまたは第三者に対して一切の責任を負いません。

11. Changes to Terms / 規約の変更

We may revise these Terms at any time. Updated Terms become effective upon posting on this page. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We encourage users to review this page periodically.

当方は、本規約をいつでも改定できるものとします。改定後の規約は、本ページに掲載された時点で効力を生じます。変更後も本サービスの利用を継続された場合、改定後の規約に同意したものとみなします。定期的に本ページをご確認ください。

12. Governing Law and Jurisdiction / 準拠法および管轄

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Japan.

本規約は日本法に準拠し、日本法に従って解釈されるものとします。本規約に起因または関連して生じた紛争については、日本の裁判所を専属的合意管轄裁判所とします。

13. Severability / 分離可能性

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

本規約のいずれかの条項が無効または執行不能と判断された場合でも、残りの条項は引き続き完全に効力を有するものとします。
